Dr. Emmanouil Mavrantonakis, senior associate in our Litigation & Arbitration practice, drafted a case note on judgment no. 6290/2025 of the Athens Three-Member Court of Appeal, published in the latest issue of the legal journal Chronika Dikonomikou Dikaiou (2026/1, pp. 239 et seq.).
The case note addresses key issues in arbitration practice, including the revival of arbitration agreements following the setting aside of arbitral awards in domestic arbitration and the question whether Law 5016/2023 on international commercial arbitration may apply by analogy to domestic arbitration proceedings.
It further examines whether a breach of res judicata may constitute a violation of international substantive public policy within the meaning of Article 33 of the Greek Civil Code and provides a concise overview of the cases in which Greek courts have recognised such a violation.
