On 3 September 2026, the European Commission adopted its first comprehensive Guidelines on the application of Article 102 TFEU to exclusionary abuses of dominance. Published in the Official Journal on 9 September and replacing the Commission’s 2008 Guidance on enforcement priorities, now withdrawn, the Guidelines close a three-year consultation with businesses, member states, national competition authorities and other stakeholders.
